Terms of Service

1. Who operates mitchyduck

mitchyduck is controlled by its owners (“the owners,” “we,” “us,” or “our”). Vluxon, Inc. operates and hosts the service infrastructure on behalf of the owners and acts as the service’s data holder and infrastructure provider. Vluxon, Inc. is located at 2261 Market Street, STE 74184, San Francisco, CA 94114, United States.

2. Agreement and eligibility

By accessing or using mitchyduck, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be legally able to enter into this agreement and meet the minimum age required to use Discord in your jurisdiction. If you use the service for an organisation, you confirm that you have authority to bind that organisation.

3. Accounts and access

Access is private and controlled through permissions. You must use your own authorised Discord account, keep it secure, and meet any Discord server membership or role requirements applied to your account. You are responsible for activity performed through your account. Tell us promptly if you believe your account or session has been compromised.

4. The service

mitchyduck provides market observations, historical statistics, collector status, personal sheets, sharing tools, and related analytics. Features may change, be interrupted, or be withdrawn. Access does not create a right to continued availability or to any particular feature.

5. Market information

Prices, averages, sales, freshness indicators, metadata, and calculations may be delayed, incomplete, or incorrect. They are provided for information only and are not financial advice or a guarantee of an in game result. You remain responsible for decisions made using the service.

6. Acceptable use

You must not misuse the service. In particular, you must not:

• share accounts, impersonate another person, or bypass Discord or application access controls;
• probe, attack, disrupt, overload, scrape, or automate the service without our prior written permission;
• circumvent rate limits, permissions, maintenance controls, or technical restrictions;
• introduce malicious code or use the service in violation of law or the rights of another person;
• access, alter, collect, or disclose information that you are not authorised to handle; or
• publish credentials, private logs, share codes, vulnerability details, or other sensitive information.

7. Sheets and share codes

You control the players placed in your sheets. Anyone with an active share code may create an independent copy of the shared sheet. Treat share codes as private, revoke them when no longer needed, and do not place confidential or unlawful information in sheet names.

8. Suspension and termination

We may restrict, suspend, or revoke access when reasonably necessary to protect users or systems, enforce these terms, respond to Discord role or membership changes, investigate misuse, comply with law, or maintain the service. You may stop using the service at any time.

9. Third party services

The service relies on other providers, including Vluxon as its infrastructure provider, Discord, and market data providers. Their terms and privacy practices may also apply. mitchyduck is independent and is not endorsed by or affiliated with Electronic Arts, EA SPORTS FC, Discord, or any market data provider unless expressly stated.

10. Intellectual property

The mitchyduck application, branding, and original software are owned by the owners or their licensors. Third party names, game content, trademarks, and data remain the property of their respective owners. These terms grant only a limited, revocable, nonexclusive right to use the service as permitted by us. They do not transfer ownership rights.

11. Privacy

Our Privacy Policy explains how the owners determine the use of personal information and how Vluxon holds and processes that information as the infrastructure provider acting on their behalf.

12. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” The owners disclaim warranties of uninterrupted availability, accuracy, merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that every error, interruption, or security risk can be prevented.

13. Limitation of liability

To the maximum extent permitted by law, the owners, Vluxon as infrastructure provider, and their respective directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, loss of data, loss of opportunity, or in game losses arising from the service. Nothing in these terms limits liability that cannot lawfully be limited, including rights available under mandatory consumer law.

14. Security reports

If you discover a potential security issue, stop testing once you have enough information to explain it. Do not access, alter, download, or disclose another user’s information. Send the report privately to [email protected] with the subject “mitchyduck Security Report,” or send a direct message to Mitch or Duck through the official mitchyduck Discord community. Include clear reproduction steps and remove passwords, tokens, and unrelated personal information. Do not post vulnerability details publicly.

15. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Before filing a claim, please contact the owners so we can try to resolve the issue informally. Subject to any mandatory rights that apply where you live, disputes will be brought in the state or federal courts located in San Francisco County, California. Nothing in this section removes rights that cannot be waived under applicable consumer law.

16. Changes and severability

We may update these terms as the service or applicable requirements change. The date above identifies the latest version. If a provision is found unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision is not a waiver of it.
